These are drafts for SmashIT to read and change. All three describe exactly what this website does today.
Terms of sale
Who you are buying from
The store is run by SmashIT Padel, Stellenbosch, South Africa. SmashIT take your order, pack it and send it themselves. The brands who sponsor SmashIT supply the stock, but your contract is with SmashIT and nobody else — you deal with one business from the order to the return.
Prices
Prices are in South African rand and include VAT where VAT applies. The price charged is the price held on the store’s own server at the moment you pay, not the price shown in your browser if the two have drifted apart.
Delivery
Delivery is R75 by courier, and free on orders over R2 000. Delivered in 2–5 business days. You can instead collect at the next SmashIT event, which is free.
The courier is booked by SmashIT once your payment has cleared.
Payment
Payment is taken by Yoco on Yoco’s own secure page. Your card details are never entered on this website and are never seen by SmashIT or by Vanguard Media.
Your order is confirmed when Yoco confirms the payment to the store, not when your browser returns to this site.
If something is out of stock
An item can occasionally be sold after it has run out. If that happens SmashIT will contact you and refund that item in full.
Anything SmashIT know is unavailable is marked Sold out on the shop and cannot be added to a basket.
Your rights
Nothing in these terms limits your rights under the Consumer Protection Act 68 of 2008 or the Electronic Communications and Transactions Act 25 of 2002, including the right to cancel certain purchases made at a distance.
Privacy notice
This notice describes what this website actually collects. It is deliberately short, because the website does very little.
When you buy something
To take an order SmashIT collect your name, email address, mobile number and — unless you are collecting at an event — your delivery address. All of it is used for one purpose: getting your order to you.
Your name, address and mobile number go to SmashIT, who pack and post your order, and to the courier who delivers it. They are not passed to anybody else, and never to the brands who sponsor SmashIT.
Order records are kept for 30 days and then deleted automatically. That is long enough for a late payment notification and a dispute, and no longer.
When you send a message
The enquiry form sends your name, email address and message to SmashIT so they can reply. It is not added to a mailing list.
Counting visits
Nothing about your visit is measured unless you agree to it. If you do, Google Analytics counts which pages are used, with your IP address shortened. You can change your mind at any time and nothing further is collected. If you have not agreed, no analytics cookie is set at all.
What is never done
Your details are not sold, not rented, and not shared with anybody other than the payment provider taking the payment and the courier delivering your order.
Your rights under POPIA
Under the Protection of Personal Information Act you may ask what SmashIT hold about you, ask for it to be corrected, or ask for it to be deleted. Use the enquiry form and they will answer.
Returns and refunds
If something is wrong with your order, email SmashIT and they will sort it out. One address, one conversation — you are not sent to a supplier.
How to start a return
Email SmashIT at the address your confirmation email came from — just reply to it — or send a message here, with your order reference, what you bought and what the problem is. Your reference is on the page you saw after paying and in your confirmation email. Photographs help if something arrived damaged.
You are not sent to a supplier or a sponsor at any point. SmashIT sold it to you and SmashIT sort it out.
Faulty, damaged or not as described
Covered by the Consumer Protection Act. You are entitled to a repair, a replacement or a refund, and SmashIT will arrange it. Tell them within a reasonable time of it arriving.
If an item is unavailable after you have paid
It is refunded in full. Stock can occasionally run out between the order being placed and the parcel being packed.
Refunds
Refunds go back to the card or account the payment came from, through Yoco. How long it takes to appear depends on your bank.
Changing your mind
Under the Electronic Communications and Transactions Act you may cancel certain purchases made at a distance within seven days of delivery and return them, unused and in their original packaging, at your own cost. Email SmashIT first so they know it is coming.
Last reviewed: this is a preview and has not been reviewed by SmashIT or by a lawyer.
We would like to count visits to see which pages are useful. Nothing is measured until you say yes, and we never sell anything we collect.
